lucky2go - terms and conditions (1.1)

  1. GENERAL INFORMATION
    1. This Terms and Conditions regulate terms of use of the “Reservation system” of third parties’ services available on www.lucky2go.com website and via Call Center and terms of providing marketing content on the website dedicated to users according to their location and network traffic analysis through information gathered thanks to geolocation, cookies and other functionalities enabling tracking of Users’ activity and personalizations of the presented offers.
    2. System is operated by eSKY.pl Spółka Akcyjna, with its registered office in Radom, 8 Jagielloński sq., registered in the National Court Register kept by District Court for the Capital City of Warsaw, XIV Commercial Division, under the reference number 0000383663, VAT Number: 9481987199, REGON 670140736, share capital 990 405,10 PLN paid in full. The company offers its reservation and information services on lucky2go website, hereinafter referred to as lucky2go.
    3. In order to use Reservation System and Call Center services (at telephone numbers available on www.lucky2go.com website) it is obligatory to accept all below provisions of the Terms and Conditions. Acceptance constitutes a declaration of intent and results in legal obligations between the User and lucky2go.
    4. The User has right to copy, regenerate and record content of this Terms and Conditions free of charge, without the right to its commercial use.
  2. DEFINITIONS

    Following terms used below in this Terms and Conditions shall have the following meaning:

    1. Reservation System - system available on www.lucky2go.com website and via Call Center, enabling the User searching and ordering:
      1. local and international flights for any two cities as well as to estimate the cost of these flights and purchase of flight ticket.
      2. the possibility to estimate the cost and purchase travel insurance
      3. possibility to use hotel services in a chosen city (both in the country and abroad), in a chosen period, having the possibility to estimate the price of services and to book them (hotel reservation)
      4. access to other services provided by third parties and available on the website
    2. User – a person using the Reservation System or Call Center. User can also be referred to as , Recipient, Passenger.
    3. ”Low – Cost” airlines – airlines listed in the Terms and Conditions, which ARE NOT subject to general IATA conditions. Each such airline is subject to its own terms and conditions. Separate terms of service apply also to the services offered by tour operators / charter flights and other services, which may be introduced. The User is informed about this terms of service and shall read them before making reservation.
    4. Electronic payment instrument – each payment instrument, including the one with access to cash from distance, enabling its owner to make payment operations via electronic information medium or through electronic identification of the owner, including electronic cash or payment/credit card.
    5. Payment card – a card identifying its issuer and an authorized owner, entitling to make payments, and in case of a payment card issued by a bank or other institution legally authorized to grant credits – also to make payment with the use of credit, referred to in art. 4 paragraph 1 item 4 of the Act of 29 August 1997 - Banking law (Journal of Laws of 2012, item. 1376, 1385, 1529, of 2013 item. 777, 1036, 1289, 1567 as amended).
  3. GENERAL PROVISIONS
    1. Thic document stipulates the rules forming the legal basis of using the Reservation System and Call Center services.
    2. Each User shall comply with this Terms and Conditions while using the Reservation System.
    3. Reservation and purchase of each particular product offered by third parties through the Reservation System is a separate transaction and is subject to terms set out by these parties. Purchase of each product is subject to the special provisions set out in the Terms and Conditions.
  4. USER’S LIABILITY FOR THE USE OF RESERVATION SYSTEM
    1. The User confirms the full capacity to perform acts in law and contract legally binding commitments.
    2. The User agrees to use Reservation System to search for reservations, purchase flight tickets and make reservations and purchase other available services through the System exclusively in accordance with the binding law.
    3. It is not allowed to make reservations using false or somebody’s else surname or make payments for booked flight tickets or other services with false or somebody’s else payment card without the permission of its owner. Such actions will be immediately reported to the respective enforcement authorities. In the event of payment with the payment card of a third party Customer confirms that has a permission of this party and if such permission is withdrew is obliged to compensate for the accrued loss.
  5. LIMITATION OF LIABILITY
    1. lucky2go does not guarantee that at the moment next after receiving the search results, other offers will not occur in the System or in other flight tickets reservation systems than those previously searched by the System, nor will such guarantee be applicable to the past. Receiving search results unless immediately confirmed and paid shall not imply any claim of the Customer to execute an agency agreement for the sale of flight tickets or other services with the parties providing services offered through the Reservation System.
  6. PERSONAL DATA PROTECTION
    1. As the administrator of personal data, lucky2go fully respects privacy and User’s personal data protection rights and herby represents that does not disclose information about Users to third parties unless it is necessary for proper performance of transaction made by the User by choosing an offer through the Reservation System. The administrator of personal data transfered due to perform payments made with the use of national payment integrator is PayPal Spółka Akcyjna, with its registered office in Poznań, Kanclerska 15 steet, registered in the National Court Register kept by District Court for the City of Poznań Nowe Miasto and Wilda, VIII Commercial Division, under the reference number 0000347935, NIP: 7792369887, share capital 4.500.000,00 PLN paid in full. The User is free to give these data for payment processing, it is however required to do so in order to make use of the service and the User shall have the right to access these data and revise them if needed.
    2. While using Reservation System available on www.lucky2go.com website, Users may be asked to provide specific personal data, necessary for booking and issuing a flight ticket or other travel document. Regarding the nature of the service which is searching for reservation and purchase of flight tickets or other travel services, information including name, surname, sex or in case of children, youth or seniors - age, is transferred directly to the reservation system of the respective airline operating chosen by the User flight or to other respective hotel owners or other operators in case of purchasing other services. The User of the System agrees on personal data to be transferred and processed by this entities for the purpose of providing services. Personal data required for reservation of individual service are adequately indicated during the reservation process. The User has right to access and amend content of his own personal data. While using this System, User accepts the fact that his personal data are processed by these entities within the scope justified to fulfill the service. The User is free to give these data. It is however required to do so in order to make use of the service. The scope of data required for each reservation is properly marked over the reservation process. User shall have the right to access these data and revise them if needed.
    3. While searching for reservation, purchasing flight ticket or making reservation of other services available on the website, the User provides information about himself and about other persons upon their consent. Information collected in lucky2go’s data base serves exclusively for lucky2go’s internal use and enables analysis of orders and demand of the Customers i.e. processing of ordered service.
    4. User is entitled to make a consent to receive information concerning up to data promotions and information on travelling in the form of Newsletter. This consent is granted by making a statement of appropriate content, making his e-mail addres available. User may at any time opt out of receiving such information simply by clicking on a discahrging link in Newsletter footer. Information sent via Newsletter are up to date at the time of mailing. Their further availability depends on the entity that provides them.
    5. By accepting this Terms and Conditions the User confirms that personal data that he furnished are true according the Article 23 of Personal Data Protection Act of 29 August 1997 (Journal of Law from 2001, No. 101, item 926 as amended).
  7. ISSUANCE AND DELIVERY OF INVOICES
    1. For services purchased via www.lucky2go.com website or via Call Center, Customer shall receive an electronic invoice. By making payment and accepting this Terms and Conditions – the User agrees to receive electronic invoices within the meaning of Art. 2, section 32 according to the Art. 106, section 1 of the Act on VAT of 11 March 2004 (Journal of Law from 2011, No. 177, item 1054 as amended).
    2. Electronic invoice for the services shall be delivered to the email address provided in the personal data form in the Reservation System or via Call Center.
    3. In case of making reservation of service for more than one User and in case the buyer to which the invoice should be issued is not indicated, the invoice will be issued to the first User of collective reservation and delivered to the email address provided during reservation process.
    4. Regulations of individual services may indicate particular terms of invoice issuance.
    5. The User makes reservation by choosing one of the suggested by the System  options of flight connections and by filling in necessary data in the personal data form. 
  8. COMPLAINTS
    1. Complaints regarding reservations and purchase of flight tickets and other travel services shall be made in writing and addressed to the lucky2go’s office address at Murckowska 14a, 40-265 Katowice or via e-mail to the email address: complaints-de@lucky2go.com. lucky2go shall contact Customer regarding the receipt and result of the complaint within 30 days from its receipt or in the term defined by the tour operator or other service provider.
    2. lucky2go informs that if the complaint concerns services provided by other parties, lucky2go will inform User about this fact and advice possibility to make a complaint at this party or will make such a complaint on behalf and in agreement with the User if the complaint description provided to lucky2go is complete enough to enable such a complaint at the service provider.
  9. FINAL PROVISIONS
    1. lucky2go reserves the right to make changes in content of the Terms and Conditions at its sole discretion, in compliance with the rule that the Customert is bound by the Terms and Conditions accepted during reservation process and that Customer may access archival versions of the Terms and Conditions. Each Customer shall read Terms and Conditions before making reservation and is bound by the provisions of Terms and Conditions from the date of making reservation and purchase of flight ticket and other travel services.
    2. To all matters not settled in this Terms and Conditions provisions of Civil Code and Consumer Rights Act of 30 March 2014 shall apply. It shall be considered that lucky2go provides service of actual transaction referring to ordering by the User services of other parties. Return or withdrawal from the agreement is possible only if the party providing the service clearly stated such possibility. In case of consumer disputes, customers may use EU’s internet platform called ODR (online dispute resolution) what will be made available on http://ec.europa.eu/consumers/odr/
    3. lucky2go shall not be liable for Customer’s damages incurred if journey is not made due to the strike of airline employees, employees of the airports, or in case of other services: strike of railway employees, hotel staff etc. or incurred as a result of force majeure as lucky2go is not a service provider nor advisor suggesting choice of any of the offers but acts as a party making available Reservation System.

Flight Tickets (+ 2go Shield)

Flight Tickets – terms and conditions (1.0 version)

MAKING FLIGHTS RESERVATION, PURCHASE OF FLIGHT TICKETS, PAYMENT METHODS AND DELIVERY OF FLIGHT TICKETS, INVOICES
  1. In case of airlines which are members of IATA (International Air Transport Association), lucky2go acts as an agent of those airlines, and respective airlines, for and on behalf of which acts lucky2go, perform services for the User and shall be liable for non-performance or improper performance of the flights. The name of the respective airline is each time indicated during the reservation process and also on the flight ticket delivered to the User.
  2. In case of low-cost airlines lucky2go acts as an intermediary proceeding actual transaction of ticket purchase directly at those airlines, on behalf of the User and strictly according to the User’s order placed through the Reservation System or via Call Center. Performance of the service and processing complaints is subject to the general terms of the respective carriers indicated during the transaction process.
  3. In case of charter flights organized by tour operator lucky2go acts as an agent and makes available conditions set out by the organizer of the flight. The organizer of the flight shall be liable for non-performance or improper performance of the charter flight service.
  4. The party of transport agreement providing air transport service which constitutes the subject of the agreement is each time specifically indicated and defined in the offer. Agreement mentioned above is concluded and performed through lucky2go website based on general conditions of the respective carrier and according to the air fares of this carrier.
  5. Reservation inquiry
    The User makes reservation by choosing one of the options of flight connections suggested by the System and by filling in necessary data in the personal data form.
  6. Confirmation of order and change of price:
    1. The User receives confirmation of order at the provided e-mail address which comprises reservation number, information about chosen flight connection, total price of the flight ticket and the method of payment. The price of the ticket is denominated in PLN or other currency chosen in the order. The price includes in particular: net tariff, airport charge, non-refundable service fee for the issuance of the ticket. Until the payment for preliminary made reservation is received by lucky2go, the price of the ticket is not guaranteed. The service is purchased on behalf of the Customer at the Carrier at the price available in the Reservation System at the moment of receipt of the payment.
    2. Before making the payment the User shall check reservation data and information concerning the date of payment in order to purchase the ticket in the price indicated upon searching the website.
  7. Purchase of flight ticket
    1. The User can purchase flight ticket providing that all personal data he entered into the Reservation System are true. Before purchasing flight ticket the User is obliged to read and accept this Terms and Conditions and read tariff terms and conditions referring to the chosen by the User flight connection. For operations connected with the issuance of the ticket, lucky2go charges non-refundable service fee in the amount specified with respect to the particular flight and other payments (for example taxes specified in the transaction).
    2. Following the conditions of the tariff, the User will be able to choose the most price profitable flight connection and also minimize costs in case of cancellation of the ticket.
    3. If the price differs considerably from the expected price, it is supposedly due to the fact that the economic seats are fully booked. In that event please check the prices available on the neighbouring dates of departure and return.
    4. After receiving reservation order, lucky2go may contact the User in order to verify User’s data and to confirm the offer. If it is impossible to contact the User, lucky2go completes the reservation according to the order after receiving the payment in amount covering at least the price of the ticket, associated additional services requested by the User and the service fee.
    5. If the trip requires extra services (e.g. special meal, points granted in frequent flyer program, flight with an animal, excess luggage, assistance for disabled passenger, baby’s accessories or other) please contact us via telephone or via e-mail. As far as possible, passenger’s requests shall be considered by the airlines.
    6. lucky2go reserves the right to refuse to issue a ticket in case if the tariff chosen by the User does not comply with its purpose according to the sale conditions within the offer or there are other justified limitations in the agreements between the airlines over which Lycky2go has no control. Non-compliance of the tariff with its purpose refers above all, but not exclusively, to false statements of the User regarding credits, age etc. affecting ticket price or to infringement of other tariff terms defined by the Carrier over which lucky2go has no control. The User is informed about the tariff terms during reservation process and shall read them before making reservation.
  8. Methods of payment:
    1. Following payment methods for purchased flight tickets are accepted on www.lucky2go.com website:
      • payment with electronic payment instrument,
      • bank transfer,
      • cash deposit,
      • payment through a national payment institution which offer was made available by lucky2go on its website and on terms stipulated by this institution
    2. The choice of preferred payment method is made by the User in personal data form in the Reservation System.
    3. Payment for „Low Cost” tickets purchased on-line can be made solely with the electronic payment instrument during the process of online transaction or by bank transfer (if such service was checked in the reservation form or requested in Call Center) – the payment shall be made immediately, due to the possibility that the price will be changed by the airline.
    4. Bank transfer for flight tickets booked at www.lucky2go.com can be made at least 2 days in advance. Choosing “bank transfer” as payment method, User is obliged to make due payment for purchased tickets within 24 hours from booking time.
    5. Bank tansfers and cash deposits are to be transfered on the following bank accounts:

    6. User’s (Passenger’s) name as well as booking number have to be stated on the transfer. Flight tickets paid by transfer or by cash deposit are issued by lucky2go on the date of booking the correct amount for flight tickets on the above mentioned account number - booking has to be made before 8 pm. This doesn’t concern holidays - a proper information is published on agency’s website. Attention! Airlines may limit possibility to issue tickets up to 72h from the reservation date or up to 24h or less in case of particular tickets with special tariffs. If lucky2go does not receive payment in the term and in the amount enabling purchase of the ticket within limitations defined by the airlines User’s reservation can be cancelled. lucky2go is not liable for cancellation of User’s reservations caused by the delayed payments made after term indicated in this Terms and Conditions and individual information provided to the User. Considering frequent changes of prices, lucky2go recommends choosing payment with payment card during reservation process.
    7. Payment with electronic payment instrument:
      • The User of on-line flight ticket Reservation System can make payment using VISA, Euro card, MasterCard, Diners Club, American Express payment cards or other payment instrument referred to in Payment Service Act (Journal of Law from 2011, No. 199, item 1175 as amended)
      • Purchase transaction with the use of electronic payment instrument is safe.
      • By choosing „payment card” as payment method the User shall fill in personal data form fields defining data of used payment card (such as: card type, card number and validity date). After reservation is made, payment card is automatically authorized by the Reservation System in order by phone system and charged with the due amount of purchased flight tickets. Attention! Giving incorrect data of payment card (such as card number or validity dage) results in rejection of the inquiry by the Reservation System.
      • Payment card is charged in two transactions. The ticket price net plus airport charges is charged by the airline. The amount of service fee is charged by lucky2go. lucky2go reserves the right to charge the due amount in one charge.
  9. Flight ticket form
    lucky2go issues tickets in the electronic form.
  10. Delivery of electronic flight ticket
    Flight tickets purchased on www.lucky2go.com are delivered to the email addresses indicated in personal data form in the Reservation System or provided during the purchase process via Call Center.
  11. Cancellation of reservation by fault of the Carrier:
    1. lucky2go shall not be liable for changes in Users’ reservations and cancellations of those reservations made by the airlines without lucky2go’s involvement. Information about possible changes in reservation is sent by lucky2go to the email address provided in the personal data form or is passed over via phone on provided telephone number.
    2. All claims resulting from cancellation or changes made by the airlines including delays of the flights, shall be addressed to the respective airlines. Airlines are liable on the basis of Warsaw Convention and Montreal Convention.
  12. Return of the flight ticket:
    1. The User has right to return the flight ticket purchased on www.lucky2go.com under the condition that the return is made before the date defined as the departure date and if it is allowed according to the flight ticket tariff conditions of which are set by the airline and which the User shall read before making flight ticket purchase. By the return of the ticket, the penalty fee is charged in the amount defined by the airline. In case of disagreement between the parties indicated as passengers regarding return of the ticket, the declaration of intent of the party making the payment shall prevail unless, by making reservation, parties making the payment within one reservation were clearly indicated.
    2. In order to return electronic ticket, the User shall contact Call Center.
    3. Depending on the payment method return of the amount due to the User for the returned flight ticket is made directly to the bank account of the User or to the account of the payment card within 7 days from the date the amount due from the airline is received by lucky2go. The return date is considered to be the date when money is debited from lucky2go’s bank account.
  13. Changes in the reservation
    1. Any modification to the reservation shall be reported to us via the Call Centre or a contact form available on our website: If there is less than 48h left to the flight, it is necessary to contact the Call Centre.
    2. The price depends on the statutory rates of the airline operating a given flight. The total cost of a change in the reservation includes:
      1. a standard charge for a change or an additional service (which is comprised of a charge for ticket modification pursuant to the terms and conditions and the table of fees of a given airline, as well as of a non-refundable service fee for modifying the order or ordering an additional service)
      2. the difference in tariff prices (a difference of costs between the initial price of a ticket and its price at the moment of the change)
      3. the difference in taxes and airport charges (a potential difference in costs between the initial value of taxes and charges and their value at the moment of the change).
    3. The Client can pay with a payment card, via transfer or make a cash payment in a bank to account. Payment with a payment card should be made via Call Centre. In the case of a transfer payment, the Client receives an email with a confirmation of changes, which includes: the details of the reservation (the reservation number, passengers’ details, information about the connection and additional services), payment information and the cost of the change.

  14. Promotional tariffs – limitation of liability:
    Some promotional tariffs available in the Reservation System have strictly defined conditions of making reservations and issuing flight tickets. It refers in particular to tariffs which shall be booked and purchased at least 3, 7 or 14 days in advance. Non-compliance with these conditions may result in change of price of a flight ticket. lucky2go reserves the right to cancel reservation of the User made 3, 7 or 14 days before the departure date in case if the purchase time limit defined in the tariff conditions provided by the Carrier is exceeded by the User. The airline may request prior issuance of the ticket. In such an event the User will be informed about the requested purchase date via e-mail at the provided email address.
  15. Combined Flights
    1. General Provisions
      1. Booking Combined Flights is one of the services provided to the Users in the Booking System. A flight marked as a ’Combined Flight’ consists of at least two flight connections with transfer(s), operated by one or more Carriers, where each flight is considered a separate service and the Carriers do not cooperate in organizing such flights (‘Combined Flight’). The combination of flights searched through the Booking System under the Combined Flight service shall be hereinafter referred to as ’Travel’.
      2. Purchasing a ticket for a Combined Flight means purchasing more than one flight ticket involving a few transfer flights for which the User receives separate plane tickets with one or more carriers under a single transaction process in the Booking System. The total tickets purchased for a given Combined Flight Travel is not a single combined air ticket for individual flights as part of the Travel.
      3. Purchase of separate tickets for each flight under a Combined Flight by the User and the fact that there may be short transfer periods between individual air connections (depending on the search parameters indicated by the User and the availability of flights in the Booking System) may potentially be subject to the risk of cancellation, delay or change of flight time and the resulting inability to use another connection(s) for the Travel.
      4. The availability of Combined Flights in different combinations depends on the availability of flight tickets with respective carriers as well as on the criteria laid out by the User himself in the Booking System.
      5. When search results show the information about a Combined Flight, the Booking System provides additional protection for such flights as part of the Travel, which means that after purchasing tickets for this Travel, the User will receive required assistance for the proper completion of the Travel from lucky2go on the terms set out below (hereinafter referred to as ’2go Shield’):
    2. The basics of using 2go Shield:
      1. The User may use the 2go Shield if one of the connections as part of the Travel is cancelled, delayed or the flight time has been changed, resulting in the User's inability to make the planned transfer as part of the Travel or to reach the Travel destination.
      2. If lucky2go receives information of the cancellation, delay or change of time of at least one of the Combined Flight connections, resulting in the inability to carry out the Travel, lucky2go shall immediately notify the User by phone (using the telephone number indicated in the booking process) of the possibilities available to him through 2go Shield to complete the planned Travel or refund the Combined Flight ticket price on the terms set out below.
      3. The telephone information shall be provided to the User who indicated his current and correct contact details in the Combined Flight booking process. Providing information to this User means that all other participants of the Travel using the Combined Flight ticket have been notified.
      4. If it is impossible to contact by phone the User who indicated his contact details in the Combined Flight booking process (lucky2go makes three attempts to contact the User by phone after obtaining the above-mentioned information about the Travel), a notification shall be sent to the e-mail address indicated in the Combined Flight booking process to confirm that lucky2go made the contact attempts and the User is unable to carry out the Travel, including the use of 2go Shield.
      5. Sending an e-mail notification in accordance with the procedure set out above means that the User has been notified of the cancellation, delay or change of time of at least one of the Combined Flight connections, resulting in the inability to carry out the Travel.
      6. If the User receives information of the cancellation, delay or change of time of at least one of the Combined Flight connections, resulting in the inability to carry out the Travel, the User shall notify lucky2go that he is unable to use the next connection as part of the Travel and the reasons for this on the following terms:
        1. If, earlier than 48 hours before the planned beginning of the Travel, the User learns about the cancellation, delay or change of time of at least one of the Combined Flight connections, resulting in the inability to carry out the Travel, the User may use 2go Shield, only when he immediately notifies lucky2go by phone, no later than within 12 hours from the moment the User receives such information.
        2. If, later than 48 hours before the planned beginning of the Travel, the User learns about the cancellation, delay or change of time of at least one of the Combined Flight connections, resulting in the inability to carry out the Travel, the User may use 2go Shield, only when he immediately notifies lucky2go by phone, no later than within 1 hour from the moment the User receives such information.
        3. Failure to notify lucky2go of the aforementioned dates shall result in failure to protect the Travel by 2go Shield.
      7. lucky2go accepts notifications from Users 24 hours a day, 7 days a week. Notifications are accepted by phone using the telephone number indicated in the ’Contact‘ tab on the lucky2go website. Outside of the hours indicated on the lucky2go website, the User service is available at +44 808 168 93 99 in English.
      8. The User shall have the right to use 2go Shield only if he exercises due diligence that can be expected from him to make it to each successive connection available as part of the Travel, even if there has been a cancellation, delay or change of at least one of the Combined Flight connections, resulting in the inability to carry out the Travel.
      9. lucky2go reserves the right to verify and determine the times of arrival and departure of aircraft and the time available for transfers between connections based on the systems used by luck2go and on data in the GDS booking system or at www.flightstats.com website.
    3. The scope of assistance available to the User under 2go Shield:
      1. Having received information from the User authorized to use 2go Shield of a cancellation, delay or change of time of at least one of the Combined Flight connections, resulting in the inability to carry out the Travel, lucky2go shall notify the User of the available alternative connections, allowing the User to reach the Travel destination (hereinafter referred to as ’Alternative Connection‘).
      2. If the passenger loses the connection as a result of a cancellation, delay or change of time of at least one of the Combined Flight connections as part of a Travel that has already begun, resulting in the inability to carry out the Travel, the User shall have the right to choose:
        1. An Alternative Connection offered by lucky2go within the time similar to the originally planned Travel at the expense of lucky2go, provided that the costs of tickets for the Alternative Connection indicated by luck2go will not exceed the reasonable cost of the lost connection as part of the Travel (‘Limit‘). If the Alternative Connection chosen by the User exceeds the Limit, about which was properly informed, the User shall pay the extra costs i.e. the difference between the amount within the Limit and the final total ticket price.
        2. If the Alternative Connection offered by lucky2go guarantees arrival at the point of destination not later than 24 hours after the originally planned time of the Travel, the rejection of the Travel under the Alternative Connection by the User shall result in the loss of the right to use 2go Shield.
        3. If the Alternative Connection does not guarantee arrival to the point of destination not later than 24 hours after the originally planned time of the Travel and the User rejects the Alternative Connection proposed by lucky2go, the User shall be authorized to receive a refund for all unrealized sections of the Travel instead of reimbursement of the Alternative Connection costs. To receive the refund of the Combined Flight amount, the User must submit evidence confirming that the cancellation, delay or change of time of at least one of the Combined Flight connections, prevented him from completing the Travel; the evidence shall be the basis for lucky2go to decide whether the refund can be granted.
      3. If at least one of the Combined Flight connections is cancelled, delayed or the time of at least one of the Combined Flight connections is changed, resulting in the inability to carry out the Travel before it begins, and reported on the terms set out above, the User shall have the right to:
        1. An Alternative Connection guaranteeing that the point of destination or point ending the Travel (depending on which section is cancelled) is reached not later than 24 hours after the originally planned time of reaching such a point, carried out at the expense of lucky2go, provided that the value of such an Alternative Connection does not exceed twice the original price of the ticket purchased for the section covered by the Alternative Connection, and at the same time does not exceed the total price of the Combined Flight ticket. In each case when the cost of Alternative Connection exceeds twice the original price of the ticket purchased for the section covered by the Alternative Connection lucky2go shall inform the User.
        2. A refund provided by lucky2go of the total price of the Combined Flight instead of refunding the costs of individual Alternative Connections if the value of the Alternative Connection exceeds the total price of the Combined Flight or arrival to the point of destination exceeds 24 hours in relation to the originally planned time of arrival.
      4. If at least one of the Combined Flight connections is cancelled, delayed or the time of at least one of the Combined Flight connections is changed, resulting in the inability to carry out the Travel before it begins, and reported on the terms set out above, the User shall have the right to:
        1. One night at a hotel realised through and at the expense of lucky2go or, if accommodation through lucky2go is impossible, a refund of the costs of accommodation made personally by the User, up to €100 for a single room and/or up to €125 for a double room, based on the documents submitted to confirm the payment and the service obtained from the hotel.
        2. A refund of transport costs (according to the four people per taxi principle) on the route to/from the hotel/airport to the amount of €50 based on the documents confirming the payment and the transport service.
        3. A refund of meal costs up to a total of €25 per person, based on the documents submitted to confirm the payment for a meal.
      5. lucky2go shall send to the e-mail address provided by the User in the Combined Flight booking process a confirmation of the User's decision to use or not to use the Alternative Connection offered by lucky2go under 2go Shield.
      6. Any refund of costs incurred and documented by the User shall be made by lucky2go in accordance with the chosen form of payment. In the case of refunds made directly by the airline to the User to his payment card account indicated in the Booking System, the refund amount established through 2go Shield shall be reduced by any amount refunded directly to the User by the airline at particular stages of 2go Shield service, up to the Combined Flight value.
      7. Refund of the amounts payable to the User on the terms set out above shall be made within 21 days of sending the notification specified in par. III.5.
      8. 2go Shield shall not include any other costs than those described above, in particular it shall not include transport and meal costs resulting from a delay, cancellation or change of time of at least one of the Combined Flight connections which the User decided to incur as part of the Alternative Connection.
      9. If the cost of the Alternative Connection chosen by the User and additional services set out above exceeds the Limit established by lucky2go, about which was properly informed, the User shall bear the extra costs.
      10. In order to use 2go Shield, the User may be required to take certain actions, as indicated by a lucky2go consultant e.g. to report to a specific point of the airport in order to settle the formalities related to exchanging the unused ticket and continuing the Travel. Failure to take the actions indicated by the lucky2go consultant shall prevent the use of 2go Shield.
      11. If the airline and/or the airport ensured or is required to ensure an alternative connection or other services set out in these Terms (such as transport, meals) to the User, lucky2go shall be released from the obligation to cover the costs of any services, and 2go Shield shall not apply.
      12. Any loss of luggage occurring for reasons beyond the control of lucky2go shall not result in the inability to carry out the Travel and shall not authorize the use of 2go Shield.
      13. Individual purchase/exchange of the ticket by the User without involving lucky2go, shall prevent the User from using 2go Shield.
      14. 2go Shield shall not apply if the cancellation, delay or change of time of at least one of the Combined Flight connections was caused by force majeure.
      15. The User shall not be authorized to use 2go Shield after the end of the Travel.
      16. 2go Shield shall not apply when the Carrier makes a mass cancellation of flights; a mass cancellation is considered a situation when the Carrier cancels or plans to cancel at least five flights from its planned flight schedule on one day.
      17. In order to use 2go Shield, the User is required to cooperate with lucky2go, in particular to submit all documents and information as requested by lucky2go consultants.
  16. Additional services offered during the transaction process:
    1. Other services available via the Booking System of the Call Centre allow the Users to book additional services subject to fees indicated during the transaction process.
    2. An lucky2go service package, called Assistant, is a flate-rate service fee for one or more changes in the ticket made via the Call Centre, which include: assistance in making changes a the ticket, assistance in returning a ticket, ordering special luggage or animal transport, ordering a special meal or assistance for children. The terms of making changes and returns, indicated in Chapter I, paragraph 12 and 13 of these Terms and Conditions, apply. To dispel any doubts, in case there is an additional charge for the services listed in the table of service fees included in these Terms and Conditions but the User has purchased Assistant, the User needs to pay the service fee only for those services which are not included in the Assistant flate-rate service fee. By purchasing the Assistant service, the User is exempt from paying service fees charged by lucky2go indicated in the table of service fees for additional services to changes in a purchased ticket; if an airline charges a fee for changes/returns/additional services in keeping with the conditions of the tariff, the User is obliged to pay for the service as indicated by the airline. lucky2go informs that the provision of an additional service or a modification in a purchased ticket requires acceptance from the airline in order to be valid. In case an airline does not accept a given service or modification of a ticket, it cannot be processed.
    3. Online check-in enables to check-in in the electrical system of particular airlines for the purchased Airline Ticket if such a possibility is provided in the booking process. As part of the online check-in, the generated boarding pass is sent to the e-mail address provided by the User during the booking process. The boarding pass is sent within a time enabling proper use of the transport service. Some airlines may oblige the User to provide additional information not available in the booking process for the purpose of check-in. The User is obliged to provide current contact details, such as e-mail address and phone number, in order to enable contact, especially directly before the flight. The lack of contact details, providing contact details to online check-in less than 48 hours before the planned departure, providing inaccurate or incomplete contact details, not answering phone calls from eSky may prevent online check-in and may be associated with additional fees specified by the airlines or with lack of possibility to  carry out transport services.
    4. A safe ticket – in case a flight is delayed or cancelled, after analysing the details of the User's flight, lucky2go will inform the User about which entity to address in order to receive appropriate compensation. At the same time, pursuant to Regulation (EC) No 261/2004 of the European Parliament and of the Council, lucky2go informs that the User is entitled to make claims and file applications directly with the airline operating a flight in order to receive a full (where applicable) compensation, to which a passenger may be entitled.

  1. GENERAL REGULATIONS
    1. lucky2go is not a party to a contract for the provision of hotel services and other related agreements, concluded through the Reservation System, for it is always a service provider specifically indicated by the offer, providing services covered by the agreement. The foregoing agreements concluded through lucky2go website, are entered into and implemented on the basis of general conditions of individual service providers. All data in the offer presented on www.lucky2go.com are based on data provided directly by the hotel providers.
    2. Following terms used below in this Terms and Conditions shall have the following meaning:
      1. Provider - hotel service provider or provider of any other related services that offers services described in detail in each individual offer through www.lucky2go.com or other cooperating with lucky2go entities’ websites.
      2. Hotel services - temporary and generally available rental houses, apartments, room, beds and also places to set up tents or trailers and providing any other related services within the facility
    3. Subject Matter
      This Regulations governs the rules of facilitating hotel services offered by third parties and available on www.lucky2go.com, to the Users.
    4. lucky2go provides:
      1. direct access to both the facilities inside the country and abroad that are offered by hotel providers,
      2. ability to make use of packages that are freely and individually configurable by the Users
  2. POSSIBLE OPTIONS OF HOTEL RESERVATIONS
    1. Depending on the provider’s offer, following rules of reservations and payment for hotel services can be specified:
      1. making a reservation of hotel service via Reservation System and, at the same time, making due payment on the date stated in the offer of a facility directly on the provider’s account - lack of payment dot lucky2go
      2. making a reservation of hotel service via Reservation System and, at the same time, making due payment on the date stated in the offer, on lucky2go account.
    2. Due to the ability to verify the accuracy of data and secure of payment for a reservation, the following can be specified:
      1. non-guaranteed reservation that has not been paid by the User
      2. guaranteed reservation that has been paid by the User or the User data has been positively verified on the conditions set forth in these Regulations.
  3. MAKING HOTEL SERVICES INQUIRIES AND RESERVATION
    1. Reservation inquiry
      The User makes reservation inquiry by choosing one of the available options - options - electronic Reservation System on www.lucky2go.com, websites owned by entities cooperacint with lucky2go or contact with Call Center and by filling in necessary data in the personal data form.
    2. Confirmation of order and price:
      1. The User receives confirmation of order at the provided e-mail address which comprises inquiry, reservation number, information about chosen hotel service, total price of the service and the method of payment.
      2. Completing a reservation by the User is an obligation to use that hotel service.
      3. The price of hotel service is denominated in PLN or other currency chosen in the order. The price includes in particular: net tariff, additional fees, final cleaning and other charges specified in the reservation.
      4. Until the payment for preliminary made reservation is received by lucky2go (according to the regulations of a given reservation), the price of the ticket is not guaranteed, due to the conditions set forth by Hotel Providers.
      5. Before making the payment the User shall check all the data contained in the received confirmation.
    3. Purchase of hotel service
      1. The User can purchase a hotel service providing that all personal data he entered into the Reservation System are true. Before the purchase, User shall read and accept this Terms and Conditions and read reservation terms and conditions regarding the chosen facility.
      2. Following the reservation conditions, the User will be able to choose the most price profitable service and also minimize costs in case of cancellation of the reservation.
      3. After receiving reservation order, lucky2go may contact the User in order to verify User’s data and to confirm the offer. If it is impossible to contact the User, lucky2go doesn not hold the responsibility for effective confirmation of the reservation by the provider, according to the declaration, unless a guaranteed reservation was made, within the meaning of these Terms and Conditions.
      4. Each reservation is passed to a proper Provider by lucky2go on behalf of the User, and it is considered a declaration of order.
      5. Hotel reserves the right to cancel reservation in case the Customer did not check in on the date of commencment of the service in the facility offering that service. The time and conditions of such cancellation are indicated in the conditions of reservation of the facility offering given service.
    4. Confirmation of reservation
      A confirmation of the booking („hotel voucher”) together with the confirmation of possibly required payment, received on User’s e-mail address and printed by the User is considered to be a hotel service order.
  4. METHODS OF PAYMENT
    1. Methods od payment:
      1. If a payment for a service is required to be paid before arrival to the facility, dirctly on the provider’s account, the offer includes detailed data necessary to make applicable fees.
      2. If a payment for a service is required to be paid for lucky2go before arrival to the facility, following payment methods for hotel services are accepted:
        • payment with electronic payment instrument,
        • bank transfer,
        • cash deposit,
        • payment through a national payment institution which offer was made available by lucky2go on its website and on terms stipulated by this institution
      3. The choice of preferred payment method is made by the User in personal data form in the Reservation System, where:
        • Bank transfer can be solely made for the facilities (objects) reserved via www.lucky2go.pl. Choosing “bank transfer” as payment method, User is obliged to make due payment for reserved service within 24 hours from booking time.
        • Bank tansfers and cash deposits are to be transfered on the following bank account:

        • User’s name as well as reservation number have to be stated on the transfer.

          The User of on-line Reservation System can make payment using VISA, Eurocard, MasterCard, Diners Club, American Express payment cards or other payment instrument referred to in Payment Service Act (Journal of Law from 2011, No. 199, item 1175 as amended)
      4. Purchase transaction with the use of electronic payment instrument is safe.
      5. By choosing „payment card” as payment method the User shall fill in Reservation System’s personal data form fields defining data of used payment card (such as: card type, card numer, validity date, CVV/CVC code). After reservation is made, payment card is automatically authorized by the lucky2go Reservation System and then charged with the due amount of purchased services (this applies only to the reservations paid for lucky2go).
      6. Attention! Giving incorrect data of payment card (such as card number or validity dage) results in rejection of the inquiry by the Reservation System.
      7. After making payment (charge on payment card, money transfer, cash deposit) and its entering in the books, system will automatically create and transfer a voucher confirmin purchase of hotel service onto chosen by the User e-mail address. Such voucher constitutes a proof of purchase of hotel service that the User should hold for authorisation while using service in the hotel
  5. CONDITIONS OF CANCELLATION OF RESERVATION/ORDER
    1. Cancellation of reservation / order. Reservation of hotel service is subject to the cancellation policy presented on the website of a given provider.
    2. Cancellation of reservation due to unidentified user.
      In order to prevent fraud in the Reservation System and avoid charging suppliers with false or misleading reservations, lucky2go reserves the right to cancel, in particular cases, non-guaranteed reservation if it is impossible to contact the User under indicated phone number. In such cases the User is not entitled to use the hotel service. The same applies to a situation where lucky2go acknowledges that User already made some reservations that were not finalised using given e-mail address or if query feedbacks sent on this e-mail address by lucky2go were left unaswered.To prevent cancellation of reservation due to the suspicion that a given reservation was made with intention not to use it, a User is entitled to make a guaranteed reservation by giving his payment card number. Customer may be asked to send a can of his card and identity document along with filled in UCCCF form for the purpose of verification of the transaction.
  6. FINAL PROVISIONS
    1. The User of the System agrees on personal data to be transferred and states that he ha a consent of other persons for who and on behalf of who he performs a reservation, to proces this person’s data by lucky2go to providers for the purpose of realisation of the reservation proces and offer the User possible after sale suport through www.lucky2go.pl within the scope of a ordered service.
    2. lucky2go shall not be liable for Customer’s claims and damages incurred. All such requests are to be brought and carried to respective providers. lucky2go shall not be liable for improper performance of providers’ services.
    3. lucky2go and other companies cooperating within the scope of providing databases concerning hotel facilities of the providers are to create a User an access to direct offers presented by individual suppliers.
    4. Information about hotel standard and services
      International hotels classification is based on stars system and it constitutes a non-binding information about the standard of a given hotel. Hotel information available in lucky2go Reservation System is based on subjective assessment of a given hotel.

At the provided e-mail address, the User receives a confirmation of his inquiry, which includes the reservation number, information about the total price of the insurance policy and the method of payment. The price of the policy is denominated in applicable currency selected in the inquiry form.
    7. Methods of payment:
      1. The following payment methods for insurance policies purchased via lucky2go are accepted:
        1. payment with electronic payment instrument,
        2. payment via bank transfer,
        3. cash payment,
        4. payment via a national agency whose offer was published on the lucky2go website and under the conditions imposed by that agency.
      2. The User selects the preferred method of payment in the personal questionnaire in the Booking System:
